The insufficiently clarified property, usage and disposal rights of both the state lands of the Federation and the Federal States and of private property in the Amazon are a major problem for the protection and sustainable use of tropical forests and thus for maintaining global goods Biodiversity and Climate (reduction of greenhouse gas emissions). The thereby resulting beneficiary country speculation is beside the still inadequate environmental control or the dynamics of agricultural prices in the market one of the main causes of illegal logging of tropical forests.

The National Programme Terra Legal contributes to the regulation of the land tenure problem. The program has existed since 2009, and provides for the allocation of 59 million hectares of state area of the Federation in the Amazon region to approximately 200,000 family farms that were previously informal users of public land. However, overlapping institutional competencies in the management of public land, institutional capacity deficiencies and inefficient instruments have the effect that the procedures for land titling precede very slowly. With approximately 200,000 expected legitimate ownership and usage claims of family farms in the state areas of the Federation only 8,670 land titles, or about 4% certified land titles could be awarded.

So far proceed the allocation of public areas and the awarding of land titles with Terra Legal ineffective (core problem).

The module objective is: The allocation of public areas and land titling with Terra Legal runs effectively.

The project supports the implementation of the National Programme Terra Legal, by strengthening the capacities of key implementing agencies. It focuses on consulting services for institutional development, on capacity development measures for the specialists of Terra Legal and on the cooperation of key stakeholders at all three levels (especially the local community level).

In the field of activity A is to be achieved that the implementing organization SERFAL (National Special Commission on land tenure in the Amazon, Secretaria Extraordinária de Regularização Fundiária na Amazônia Legal) optimizes their internal management processes and thereby shortens the processing time for the land titling. In the field of activity B the cooperation of the regional offices of Terra Legal with relevant local stakeholders in the allocation of properties will be improved in the triangle of the states of Acre, Amazonas and Rondônia. Objective in the field of activity C is that SERFAL better fulfils its function to support land rights and land tenure systems, especially by taking advantage of international experiences and transparent information on decision-making and land awarding.

The project covers the Amazon (nine states) with a regional focus in the triangle of the states Amazonia, Acre and Rodonia.

GITEC is responsible for the implementation of the action field A of the project "Land tenure in the Amazon - Terra Legal".This aims to optimize the internal management processes for the implementation of the Brazilian Terra Legal program (short: Terra Legal) of the national implementing organization SERFAL.

Processes and procedures of Terra Legal

  • Systematic description of the existing processes and procedures
  • Development of suggestions for improvements of these processes and procedures with the participation of the partners
  • Support for piloting and implementation of the new procedures
  • Support the development and introduction of adjusted IT solutions to improve the efficiency of these methods

Staff formation

  • Analysis of existing competencies in SERVAL staff and comparison with the requirements for the implementation of Terra Legal
  • Skills development in response to the identified requirements with a focus on the job training of new employees
  • Strengthening the entrepreneurial skills of managers through coaching packages

Company development

  • Support for the introduction of target-oriented management
  • Support in defining of mandates and responsibilities and to adapt the organizational chart
  • Creating incentives, especially for employees who take on new tasks and complete retraining
  • Support of the SERFAL management in the implementation of measures for a good working climate
  • Support of the SERFAL management in the promotion of long-term culture of learning
  • Support of the SERFAL leadership in cooperation management, i.e. the establishment and strengthening of institutional partnerships and networks to promote land rights in Brazil
  • Support for external and internal communication processes.
